FAH Weighs in on CMS Insurance Marketplace Proposed Rule, Supports Enhanced Tax Credit Extension

Today, FAH submitted comments to CMS on its Marketplace Integrity and Affordability Proposed Rule. FAH urged CMS and the Administration to support extending the enhanced premium tax credits that expire at the end of this year in order to maintain health care access and affordability. 

The comments also support CMS program integrity efforts while urging CMS to strike a proper balance when implementing specific proposals to ensure that qualifying individuals are not deterred or inadvertently precluded from obtaining healthcare coverage. 

In commenting on specific issues, FAH urged CMS, for example, to: 

  • Hold agents and brokers accountable for consumer enrollment non-compliance, including imposing civil monetary penalties for such noncompliance.
  • Maintain the current annual open enrollment period (OEP) for 2026 and defer consideration of any change to the OEP.
  • Conduct additional analysis before finalizing a proposed policy that would discourage or limit automatic re-enrollment on the Exchanges.
